Terms and conditions of sale

This English version is a translation provided for convenience. In case of any discrepancy, the French version prevails.

Article 1 – Purpose and scope

These general terms and conditions of sale (the “Terms”) apply to all remote coaching plans offered under the Endurance Pace brand (“Endurance Pace”, “we”) by Cindy Lefebvre and Gino Panepinto, part-time self-employed professionals whose full details appear in the legal notice, to any individual who subscribes to them for private purposes (“you”, “the client”).

Offers to companies (for example training programmes for the 20 km of Brussels) are subject to a quote and specific conditions. These Terms apply to anything the quote does not cover.

By subscribing to a plan, you confirm that you have read and accepted these Terms.

Article 2 – Our plans

We offer remote coaching in triathlon, cycling and running, as well as tailored strength programmes, at three levels: Start, Pace and Summit. The exact content and price of each plan are described on the website at the time you subscribe and repeated in the confirmation e-mail.

Coaching is an obligation of means: we use our expertise to help you reach your goals, but we cannot guarantee a result (time, ranking, weight loss…), which also depends on your circumstances, commitment and health.

Article 3 – Health and prerequisites

Endurance sports involve risks. Before coaching starts, you agree to:

We may postpone the start of coaching, adapt or suspend the plan if these conditions are not met or if a warning sign appears, and ask you to see a doctor. Our services are not medical and do not replace a diagnosis, treatment or rehabilitation.

Minors: we also coach young people under 18, only with the written consent of a parent or legal guardian. The parent or guardian signs the contract, completes the PAR-Q+, provides the medical certificate and consents to the processing of health data.

Article 4 – Subscription and conclusion of the contract

Subscribing takes a few steps: a free discovery call (e-mail or video), choice of plan, a summary e-mail from us (plan, price, duration, start date, these Terms), then payment of the first invoice. The contract is concluded when we receive your payment and send our confirmation.

Article 5 – Prices

Prices are stated in euros, per month, all costs included. As Cindy Lefebvre and Gino Panepinto fall under the small business VAT exemption scheme, no VAT is charged.

We may change our prices. Any change is announced by e-mail at least one month in advance; you may then cancel free of charge before it takes effect. The current month is not affected.

Article 6 – Invoicing and payment

Each coach invoices their own services: your invoice is issued by the coach who follows you (Cindy Lefebvre or Gino Panepinto). It is sent to you by e-mail at the beginning of each month.

Payment is made by bank transfer, within 7 days of receiving the invoice, using the payment reference shown on it.

If a payment is missed, we send you a first reminder free of charge and give you at least 14 days to pay. If the situation is not resolved, we may suspend access to coaching. Any collection costs are limited to the amounts allowed by law (Book XIX of the Belgian Code of Economic Law).

Article 7 – Duration, commitment and cancellation

To cancel, simply send an e-mail to endurance.pace.belgium@gmail.com. We acknowledge receipt within 3 working days.

We may terminate the contract in the event of a serious breach (persistent non-payment, disrespectful behaviour towards the coaches or the community, refusal to provide health documents) or if your safety requires it. The unused part of the current month already paid is then refunded.

Article 8 – Suspension for injury or illness

On presentation of a medical certificate, you can suspend your subscription for up to one month per year of subscription. During the suspension you do not pay, and the commitment period is extended accordingly. Beyond that, we will find a solution together (adapted plan, lighter plan, cancellation).

Article 9 – Right of withdrawal

As the contract is concluded at a distance, you have 14 days from its conclusion to withdraw, without giving any reason and at no cost, by sending us the withdrawal form below or any other clear statement by e-mail.

If you expressly ask us to start coaching during this period (for example to receive your plan straight away) and then withdraw, you owe us an amount proportional to the service provided up to your withdrawal. If the service has been fully performed during the period, with your prior express consent and your acknowledgement that you would then lose your right of withdrawal, this right no longer applies.

We refund you by bank transfer no later than 14 days after receiving your withdrawal.

We undertake to provide you with personalised support, within the response times and at the frequency of contact set out in your plan, in line with scientific evidence and safety rules.

Remote coaching has limits: we do not see every session and we rely on the information you give us. You remain the sole judge of your ability to complete a session at the time you do it.

We are not liable for damage resulting from failure to follow instructions, inaccurate or incomplete health information, unsuitable equipment, or activities you do outside the plan. This limitation does not apply in the event of wilful misconduct or gross negligence on our part, nor to bodily injury caused by our fault.

Our professional liability is insured with Ethias SA; policy numbers are available on request.

Article 12 – Group activities and in-person sessions

Taking part in coffee rides, group runs and other community meet-ups is optional and free for clients. Each participant agrees to follow the instructions of the coach present, the highway code and respect the other participants. Helmets are mandatory on the bike. Everyone remains responsible for their own equipment and pace.

Article 13 – Referral

For each new person you refer who pays their first month, you receive a €20 discount on your next month. The discount is capped at €20 per month; additional discounts are carried over to the following months. It cannot be combined with a refund or exchanged for cash. The referred person receives their initial assessment free of charge. We may change or end the referral programme at any time, without affecting discounts already earned.

Article 14 – Intellectual property

The plans, programmes, videos and documents we send you are for your personal use. You may not resell, distribute or share them without our written consent.

Article 15 – Personal data

We process your personal data, including some health data, in accordance with our Privacy Policy, available on the website.

Article 16 – Complaints and disputes

For any question or complaint, write to us at endurance.pace.belgium@gmail.com: we reply within 15 days. If no agreement is reached, you can contact the Belgian Consumer Mediation Service free of charge (North Gate II, boulevard du Roi Albert II 8, box 1, 1000 Brussels – mediationconsommateur.be).

These Terms are governed by Belgian law. In the event of a dispute, the competent courts are those designated by law, in particular those of your place of residence if you are a consumer.

Article 17 – Changes to these Terms

We may change these Terms. The applicable version is the one in force on the date you subscribe. Any significant change affecting an ongoing subscription is sent to you by e-mail at least one month in advance; you may then cancel free of charge.
